Terms of Use & Privacy Policy :  Add-On

These add-on terms and conditions (“Terms of Use”) and Privacy Policies govern your use of PROCLE HEALTHWORKS REMOTE PATIENT MONITORING PLATFORM (collectively the “Service” or “the RPM Platform” or “PROCLE”) that facilitates & enables data collection from third-party remote monitoring devices, data aggregation & analysis of the collected data and assisting developing an action plan for the provider care team to take care of the patients. These terms & condition and privacy policy is over and above the terms & condition, privacy policy and disclaimer accepted by the user for using PROCLE HEALTHWORKS for Patient Education, Virtual Care and Telehealth.

PROCLE HEALTHWORKS  is a remote care management and monitoring healthcare technology provider. PROCLE’s RPM Platform helps its customers who are care provider organizations to improve health outcomes using telehealth, remote care monitoring, and general healthcare frameworks. It handles and stores data provided by patients to healthcare providers in a secure and safe manner. To use PROCLE, you must have a care plan with a healthcare provider who subscribes or has implemented PROCLE HEALTHWORKS  for its Remote Patient Monitoring requirement. The Remote Patient Monitoring is subject to your healthcare provider’s and third-party medical device company’s privacy & security policy. Please contact your healthcare organization or medical device manufacturer’s organization for any concerns or questions about their privacy and security policies.

The PROCLE RPM platform is just a data collection portal. The accuracy & interpretation of the collected device data depends upon the third-party medical devices / peripherals selected or chosen by the provider for the patient or by the patient themselves. The interpretation of the data will be done by the provider care team and PROCLE does not claim to offer any interpretation or replace provider care team’s interpretation or offer any consultation based upon the patient’s collected & analyzed data.  The provider’s assessment and consultation should be treated as the final. If you would like access or use our services you must agree to these add-on Terms of Use and Privacy policies.

PROCLE HEALTHWORKS neither provides any remote monitoring medical advice nor is a healthcare provider.  PROCLE HEALTHWORKS MAKES NO REPRESENTATIONS OR WARRANTIES REGARDING THE HEALTHCARE PROVIDERS USING PROCLE HEALTHWORKS PLATFORM OR ITS NETWORK.  ALL HEALTHCARE PROVIDERS ARE INDEPENDENT PRACTITIONERS AND PROCLE HEALTHWORKS IS NOT RESPONSIBLE FOR ANY ACTS OR OMISSIONS OF THE HEALTHCARE PROVIDERS.

As a user of the PROCLE HEALTHWORKS platform, you understand that although PROCLE HEALTHWORKS implements security safeguards, the exchange of information may not be secure and could be improperly accessed by a third party.  You also understand that there are third parties that may view or access PROCLE HEALTHWORKS and you are solely responsible for determining what information you decide to disclose/share.  You understand that PROCLE HEALTHWORKS is not responsible for the information that you share being redisclosed to a third party, user group or providers.

Medical services rendered by your physician are subject to their independent professional judgment. PROCLE HEALTHWORKS is not a healthcare provider and does not practice medicine.  Any treatment or healthcare services shall only be provided by the physician who is not engaged or employed by PROCLE HEALTHWORKS.  PROCLE HEALTHWORKS operates subject to state regulation and may not be available in certain states.  The individual physician or provider is responsible for complying with all laws.

PROCLE HEALTHWORKS  RPM PRIVACY POLICY


This policy explains how PROCLE HEALTHWORKS handles your privacy of the limited data that we collect about you and your health in relation to your care and care provider.


PROCLE is obligated to protect the confidentiality, integrity, and availability of your personal information which may be in form of Electronic Protected Health Information (ePHI). This obligation is taken very seriously, and all measures are taken to keep your personal information protected according to the Health Insurance Portability and Accountability Act of 1996 (HIPAA) privacy and security rules. PROCLE adheres to the following policies related to Data Collection, Usage and Disclosure.


Data Collection: PROCLE collects your health-related information through specially designed questionnaires and biometric entries entered on third-party medical devices provided by your care provider. The patient using PROCLE’s RPM platform offered by their healthcare provider, understands that the platform may collect, store, process, maintain, share, disclose, use, and transmit your health information including, but not limited to the information concerning the assigned device or characteristics of patient’s mobile device along with any peripherals used for the purpose of managing patient’s health biometric, as well as their personal information, location and other content.

PROCLE collect health information automatically using health peripherals / devices (Bluetooth / Cellular) or entered manually by the patient. Once collected and submitted, Patient’s health information is transmitted to a secure server. It is assumed that the third part FDA approved device provided by the healthcare provider does not store any data on the device. Patient also agrees to the third-party medical device privacy policy.

Data Usage The information is used by your Care Team member to manage your health plan. Only biometric data provided by you and your responses to the questions are stored in PROCLE’s secured database.

Data Disclosure: PROCLE attempts to minimize the amount of your personal or health information entered via devices based on the Care Team plan or program for you as a patient. Health information entered via devices is disclosed only to your Care Team and application support staff. PROCLE does not share, sell, or license your health information that it may collect via the RPM Platform.

Security of Your Health Information:

PROCLE ensures that reasonable administrative, physical and technical security measures are in place to protect your health information from compromise. PROCLE ensures effective risk analysis, risk management, and regular review activities, which will include but not limited to access and authorization assessments, privacy and security standards, policies and enforcement as it affects PROCLE’s workforce, PROCLE ensures access to facilities are highly secured and systems used in developing mobile/Web application are physically secured to protect unauthorized physical accesses. PROCLE uses encryption mechanisms such as Advanced Encryption Standard 256 bits to protect your information while in storage. PROCLE employs the use of Transport Layer Security/Secure Sockets Layer certificates and secured tokens while data is in transit. PROCLE ensures secured PIN access on the devices issued to patients, protecting from unauthorized access to the platform.

You will be reminded to take vital signs through an alert on the device. The tablet will have icons that could make it possible for others who view the tablet in your home to infer health care issues. You are requested to take precautions and employ additional administrative, physical, and technical security mechanisms to protect your Protected Health Information (PHI) and Personally Identifiable Information (PII)

Your healthcare provider and application support staff may employ additional administrative, physical, and technical security mechanisms to protect your Protected Health Information (PHI) and Personally Identifiable Information (PII)

Individual Rights:

It is your right under the HIPAA Privacy Rule to request to access, inspect, or obtain a copy of the collected health information. You can gain access to your health records or information, through online portal provided by PROCLE or through your healthcare provider.

Changes to Privacy Policy Agreement:

PROCLE reserves the right to update and/or change the terms of our privacy policy, and as such, we notify healthcare providers who will post such changes in order to keep patients aware of the type of information we collect, how it will be used and under what circumstances, if any, we may disclose such information. If at any point in time PROCLE decides to make use of any personally identifiable information on file, in a manner vastly different from that which was stated when this information was initially collected, the user or users shall promptly be notified by email. Users at that time shall have the option to permit the use of their information in this separate manner. PROCLE and its Business partners may notify patients in advance about changes to this Privacy Policy when data practices change due to updates in program or the application.

Acceptance of Terms

Using PROCLE HEALTHWORKS, you are hereby accepting the terms and conditions stipulated within the Privacy Policy Agreement. If you are not in agreement with our terms and conditions, then you should refrain from further use of the PROCLE Platform. In addition, your continued use of the PROCLE following the posting of any updates or changes to our terms and conditions shall mean that you are in agreement and acceptance of such changes.



YOUR CONSENT & ACKNOWLEDGEMENT OF ENROLLMENT

By accepting this Patient Consent & Enrollment Form, I (Patient) hereby explicitly consent to enrolling in the Remote Patient Monitoring (RPM) services provided to me by the healthcare provider along with PROCLE Healthworks.

·      I (Patient) acknowledges that I will comply with the instructions & guidelines about health vital monitoring provided by the providers, PROCLE RPM Platform developer and the Medical Device manufacturers.

·      I (Patient) acknowledge that I will take the readings as per the provider’s instruction and will comply with their health monitoring requirements.

·      I (Patient) understand that I can only participate in this program with one Medical Provider at a time.

·      I (Patient) will not tamper with the equipment and understand that I am responsible for any fees associated with misuse of this equipment or the platform.

·      My data and medical information obtained from my participation in the RPM program may/may not be considered part of my patient record but may be shared with other health care professionals to enhance my care and I authorize such professional disclosure. My data and information will be securely transmitted data and reviewed at the clinician’s discretion.

I have read and understood the information and consent to participate in the Remote Patient Monitoring program as stated above. I am aware that this consent is valid as long as I’m enrolled in the RPM program and I’m in possession of the RPM equipment/device.
